These Terms of Service ("Terms") govern your access to and use of AussieMigrate.com, including our website, customer portal, AI tools, assessments, document services, and related support ("Services").

By creating an account, purchasing a Service, or using the Services, you agree to these Terms. If you do not agree, you must not use the Services.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement.

You agree to provide accurate, current, and complete information and to comply with applicable laws.

If you provide information or act for another person, you confirm that you have their lawful authority and any required consent.

2. Our Services

AussieMigrate is a technology-enabled immigration platform that provides AI-powered Immigration Eligibility Evaluations, administrative support services, document preparation assistance, and, where purchased, access to regulated immigration assistance provided by an appointed Australian registered migration agent.

Our Services may include, depending on the product or package purchased:

  • AI-powered Immigration Eligibility Evaluations based on the information you provide;
  • Educational information about Australian visa pathways;
  • Personalized visa pathway recommendations;
  • Document checklists and document preparation assistance;
  • Administrative support throughout your immigration journey;
  • Application preparation and submission assistance;
  • Ongoing customer support;
  • Regulated immigration assistance provided by an appropriately appointed Australian registered migration agent where required by law and included in your purchased Service.

The specific Services included in your purchase will be described on the relevant product page, quotation, checkout page, order confirmation, Retainer Agreement, or other professional services agreement.

3. Regulated Immigration Assistance

AussieMigrate is a technology-enabled immigration platform that provides AI-powered Immigration Eligibility Evaluations, administrative support services, and document preparation assistance.

The purchase of an AI Immigration Eligibility Evaluation or any other preliminary Service does not constitute regulated immigration assistance and does not establish a migration agent-client relationship.

Where a customer chooses to proceed with regulated immigration assistance, application preparation, application submission, or representation before the Australian Department of Home Affairs or any other relevant authority, such services will be provided by or under the supervision of an appropriately authorised Australian registered migration agent or Australian legal practitioner, as required by applicable law.

Before any regulated immigration assistance is provided, the customer will receive:

  • the identity and registration details of the appointed registered migration agent or Australian legal practitioner;
  • all disclosures, consumer information, authorisations, and consent documents required under applicable Australian law;
  • a separate Retainer Agreement governing the scope of professional services, fees, responsibilities, cancellations, refunds, and other applicable terms.

Regulated immigration assistance will commence only after the applicable Retainer Agreement has been accepted by the customer and all required onboarding requirements have been completed.

Until that time, any Services provided by AussieMigrate are limited to technology services, AI-generated Immigration Eligibility Evaluations, educational information, administrative support, customer support, and document preparation assistance, and should not be interpreted as regulated migration advice.

Where applicable, the appointed registered migration agent or Australian legal practitioner will remain independently responsible for complying with all professional obligations imposed under Australian migration law, professional conduct rules, and any applicable regulatory requirements.

If any provision of these Terms conflicts with mandatory Australian laws governing regulated immigration assistance, those mandatory laws will prevail to the extent of the conflict.

4. AI and Automated Assessments

AussieMigrate may use AI and automated systems to analyse questionnaire responses, identify potential pathways, generate checklists, organise information, and assist with documents or communications.

AI output may be incomplete, inaccurate, or outdated. It is not a government decision and does not guarantee eligibility, an invitation, nomination, visa grant, or processing time.

Where professional review is included, relevant output will be reviewed according to the purchased Service.

You remain responsible for checking and approving all information and documents before submission.

Where required, we will obtain written consent before personal information is entered into an AI platform by a migration professional. OMARA guidance confirms that AI does not provide an exemption from Australian immigration-assistance requirements.

5. No Government Affiliation or Guarantee

AussieMigrate and Globridge Limited are private businesses. We are not part of, endorsed by, or affiliated with the Australian Government, Department of Home Affairs, or any Australian state or territory government.

Government bodies and relevant state or territory authorities make all final decisions.

We do not guarantee:

  1. Eligibility for a visa.
  2. An invitation to apply.
  3. State or territory nomination.
  4. A successful skills assessment.
  5. Acceptance or approval of an application.
  6. A particular processing time.
  7. That a program will remain available.
  8. Employment, accommodation, education, or settlement outcomes in Australia.

6. Accounts and Security

You are responsible for:

  1. Providing accurate account information.
  2. Keeping your login details confidential.
  3. All activity through your account.
  4. Informing us promptly of suspected unauthorised access.

You must not share your account unless authorised access is expressly permitted.

7. Your Information and Responsibilities

You must provide truthful, complete, current, and legible information and documents.

You are responsible for reviewing all forms, declarations, evidence, and submissions before they are lodged.

You must promptly tell us about changes involving your:

  1. Contact details.
  2. Passport or identity information.
  3. Family circumstances.
  4. Employment or education.
  5. Health or character matters.
  6. Travel or immigration status.
  7. Other information relevant to your application.

You must meet deadlines, respond to requests, attend required appointments, and pay applicable fees.

We are not responsible for loss, delay, refusal, or additional costs resulting from inaccurate, incomplete, misleading, fraudulent, withheld, or late information.

8. Application Submission

The relevant Service description or professional-services agreement will confirm whether:

  1. You submit the application yourself.
  2. The appointed migration agent submits it as your authorised representative.
  3. Both methods are available, depending on the Service.

We will not submit or materially change an application without the required authority and approval.

You may be required to control your own government account, verify your identity, sign declarations, approve documents, and pay government fees directly.

9. Fees and Payments

Our service fees are displayed or quoted before purchase and may vary according to the Service, complexity, and work required.

Payments are processed through third-party payment providers. We do not ordinarily store full payment-card details.

Unless expressly included, our fees do not cover:

  1. Government visa application charges.
  2. State or territory nomination fees.
  3. Skills-assessment fees.
  4. Medical examinations.
  5. Police certificates.
  6. Biometrics.
  7. English-language tests.
  8. Translations or certifications.
  9. Education-provider fees.
  10. Other third-party costs.

Government and third-party fees are subject to the relevant provider's rules and may change without notice.

10. Cancellations and Refunds

Refunds, cancellations, and termination of Services are governed by the applicable Retainer Agreement or other service agreement entered into between you and AussieMigrate and/or the appointed registered migration agent, as applicable.

The Retainer Agreement will set out the terms relating to cancellations, completed work, AI Immigration Eligibility Evaluations, document preparation services, professional services already performed, customer delays, withdrawals, visa refusals, duplicate payments, and any applicable third-party fees.

Government fees, visa application charges, skills assessment fees, medical examination fees, and other third-party charges are subject to the refund policies of the relevant authority or provider and are generally non-refundable unless otherwise determined by that authority or provider.

Nothing in these Terms limits or excludes any consumer rights or remedies that cannot be excluded under applicable law, including the Australian Consumer Law.

11. Processing Times

Any timeframe provided by AussieMigrate is an estimate unless expressly agreed otherwise.

Government processing times, invitation rounds, nomination decisions, and third-party delays are outside our control.

We may pause work while waiting for documents, payment, instructions, approval, identity verification, or professional review.

12. Intellectual Property

The AussieMigrate platform, content, software, branding, assessments, checklists, workflows, and materials are owned by or licensed to Globridge Limited.

We grant you a limited, personal, non-transferable, and revocable licence to use purchased Services and deliverables for your own migration matter.

You may not copy, resell, distribute, scrape, reverse engineer, commercially exploit, or share protected materials or account access without written permission.

13. Prohibited Conduct

You must not:

  1. Use the Services unlawfully or fraudulently.
  2. Submit forged, altered, false, or misleading information.
  3. Impersonate another person.
  4. Act for someone without authority.
  5. Circumvent security or payment controls.
  6. Upload malware or harmful content.
  7. Scrape or reverse engineer the platform.
  8. Abuse refunds, promotions, chargebacks, or support channels.

We may suspend or terminate Services for material breaches, fraud, non-payment, security risks, unlawful conduct, or failure to provide necessary information.

14. Privacy

Our Privacy Policy explains how we collect, use, store, and share personal information.

You must have lawful authority to provide information about another person, including a partner, parent, child, sponsor, or family member.

15. Disclaimers and Liability

Subject to rights that cannot legally be excluded, the Services are provided on an "as is" and "as available" basis.

We do not guarantee that every assessment, checklist, document, communication, or platform feature will be error-free, complete, or current.

To the maximum extent permitted by law, Globridge Limited will not be liable for indirect or consequential loss, lost opportunities, lost income, government decisions, program changes, or delays outside our reasonable control.

Our total liability relating to a Service will not exceed the amount paid for that Service during the 12 months before the event giving rise to the claim.

Nothing excludes liability that cannot legally be excluded.

16. Third-Party Services

The Services may link to or use government portals, payment providers, education providers, skills-assessment authorities, or other third-party systems.

Third-party terms and privacy policies apply. We are not responsible for their systems, fees, decisions, availability, or practices, except where applicable law provides otherwise.

17. Governing Law

These Terms are governed by the laws of Cyprus, without prejudice to mandatory Australian or other applicable consumer, privacy, and immigration laws.

Disputes will be subject to the competent courts of Cyprus unless applicable law provides otherwise.

18. Changes and Contact Details

We may update these Terms to reflect changes to our Services, laws, government programs, security requirements, or business operations.

Updated Terms will be published with a revised effective date.
